Alaska has taken legal action against the U.S. Environmental Protection Agency (EPA), challenging a decision that effectively puts a stop to the development of one of the world’s largest untouched copper and gold deposits. Filed in Anchorage federal court, the lawsuit targets the EPA’s 2023 final determination, which bans the discharge of mining waste from the Pebble deposit into the Bristol Bay watershed.

This move by Alaska follows closely on the heels of a similar legal challenge initiated by Northern Dynasty Minerals, the mining company behind the Pebble deposit project. Both lawsuits contend that the EPA’s decision not only threatens the potential economic boon from the mining project but also significantly undermines state sovereignty.

At the heart of the dispute is the Bristol Bay watershed, a pristine environment in southwestern Alaska that supports the globe’s most abundant sockeye salmon fishery. This habitat, vital for various bird and mammal populations and home to significant mineral resources, is under threat according to the EPA. The agency cites concerns that mining waste could lead to degradation of the watershed, negatively impacting crucial fishing ecosystems.

The State of Alaska has argued that the EPA’s prohibition on the mine’s waste disposal will strip it of prospective revenues deriving from taxes and royalties. Moreover, the lawsuit alleges that the EPA’s decision was made arbitrarily, failing to adequately weigh the costs and benefits and overstepping its regulatory authority under the federal Clean Water Act. Alaska demands that the court overturn the EPA’s final determination and declare a violation of federal administrative law and overreach.

As the legal proceedings unfold, representatives from the EPA have maintained silence on the matter, and responses from Northern Dynasty Minerals are pending. With both litigation and Conservation efforts intensifying, the future of the Pebble deposit and its potential impact on Bristol Bay’s ecological and economic landscape remain uncertain. The case, lodged under the title Alaska v. U.S. Environmental Protection Agency, is currently before the U.S. District Court for the District of Alaska, marking a significant moment in the ongoing debate over resource extraction and environmental protection.
